Terms
Information about the provider, use and responsibilities.
1. Scope and contracting party
These terms concern the agreed provision of Brezel to business customers acting in a commercial or professional capacity, public-law legal entities and special funds under public law. The offer is not directed at consumers. The provider is Christian Kiewaldt & Benjamin Braun GbR, Betriebsweg 4, 51645 Gummersbach, Germany. Full contact details are provided in the legal notice. Individually negotiated agreements take precedence.
2. Registration and contract formation
Creating a free account does not itself create a paid software contract or provision a workspace. A package contract requires a separate binding booking and acceptance. The service scope, included AI usage, fees and term must be specified before booking. This website does not provide a checkout.
3. Brezel Cloud service scope
According to the confirmed package, Brezel Cloud includes personal and independent AI assistants, collaboration, company knowledge, roles and access controls, approvals and integrated password management. Setup and a monthly AI usage allowance are included. There are no additional per-employee licence fees. AI usage is not unlimited. The booked scope governs; illustrative interfaces and task examples do not create additional service obligations.
4. Prices and additional usage
The regular Cloud price is €199 per month for the whole company, plus applicable VAT. Additional AI usage can be purchased separately. The amount and price of extra services must be agreed before a binding order. Payment method and due dates follow the booking or individual offer. These terms do not establish a separate right to change prices.
5. New-customer offer
The Cloud offer for new customers has a 12-month contract term. The first Cloud month costs €0, followed by eleven months at €199 each plus VAT: €2,189 plus VAT for this term, excluding additional AI usage. Additional usage is charged separately. On premise is excluded. This is not an unrestricted free product. The offer must be explicitly available and confirmed at booking.
6. On premise and future features
On premise is provided under an individual offer. The system runs locally at the customer’s premises; agreed hardware and support are included through a Brezel Certified Integration Partner. Pricing and responsibilities are specified in the offer. On premise currently still uses an external European language model service. Content required for AI requests is processed externally according to the configuration. Local AI is a planned future extension and is not an obligation under the current service. No release date or offline operation is promised.
7. Customer responsibilities and permitted use
The customer provides content they are entitled to use, appoints responsible people and configures access and approvals for their requirements. Credentials must be protected. Unlawful use, unauthorised access and circumvention of agreed usage limits are prohibited. Suitability and safeguards must be assessed before processing particularly sensitive information. The customer provides appropriate guidance to users.
8. AI output and human responsibility
AI output can be incomplete, incorrect or unsuitable for the intended purpose. It must be reviewed in proportion to its significance and risk. Brezel does not replace qualified legal, tax, medical or other professional review. No particular economic success, output quality or complete replacement of skilled staff is promised. Important decisions remain with the responsible people.
9. Data, usage rights and confidentiality
Rights in customer-provided content remain with the respective rights holders. The customer grants only those usage rights needed to deliver the agreed service. AI output may be subject to third-party rights; exclusive or copyright-protected output is not guaranteed. Both parties must handle confidential information within the contractual purpose and protect it from unauthorised disclosure. Company data is not used to train the underlying AI model.
10. Data protection and operational security
Where Brezel processes personal data on the customer’s behalf, an agreement under Article 28 GDPR covering relevant technical and organisational measures and subprocessors must be concluded before processing. The customer is responsible for lawful grounds and permitted content. Security requires coordinated technical and organisational measures. Local deployment alone does not guarantee protection from attacks or data loss.
11. Availability, maintenance and changes
Specific availability commitments, response times and support services apply only where agreed. Maintenance and necessary security measures may temporarily affect use. Material changes to agreed services require a valid contractual basis. Statutory rights concerning service failures remain unaffected.
12. Term, termination and data return
The booked offer defines the term. The new-customer offer runs for twelve months. These terms do not establish further automatic renewals or special notice periods. Termination for cause remains available. Data return, export options, deletion periods and any chargeable assistance must be coordinated before termination according to the agreed scope and applicable law. Statutory obligations concerning service switching remain unaffected.
13. Partner services
Subject to the partner agreement, referral compensation is €500 per acquired paying customer per contract year, from year one and in each following year while that customer remains a paying Brezel customer. It applies to Cloud and on premise and excludes additional AI usage. Hardware, integration, consulting and support are agreed separately. Brezel bills the product directly to the customer. “Certified” denotes Brezel’s own partner programme; an enquiry alone does not establish membership.
14. Remedies, liability and final provisions
Statutory rules govern defects and liability unless the specific contract validly provides otherwise. These terms do not contain a blanket exclusion of liability. Individually negotiated agreements take precedence. If a provision is invalid or not incorporated, statutory rules apply. The remaining terms continue to apply to the extent provided by law.
